This e-form waiver states that you are taking full responsibility for any personal injury to you and/or to others and any damage to the bike that may occur during your test ride.

I hereby acknowledge that by filling this e-form (rider release), I am assuming all risk in test riding the bike. For myself, my heirs, executors, administrators, representatives, assignees, and successors in interest, I hereby agree to indemnify and hold harmless and irrevocably release to VMG bikes, and its members, directors, managers, officers, employees, consultants, agents, representatives, volunteers and affiliates (collectively, the “rider release”), from and against all liability, including any personal injury to me or to others, any damage caused to or by any bike, and/or any negligence of VMG bikes or me, arising from or related to, directly or indirectly, my test ride or other use of a bike.

What am I agreeing to?

I hereby agree irrevocably to waive all claims arising from or related to my test ride or other use of a bike, and to bear all cost and expenses incurred by VMG blades, (including attorneys’ fees) in defending any such suit or other action or in the enforcement of this Release. I hereby understand and acknowledge that this Release is a contract with legal and binding consequences and that I am therefore giving up substantial legal rights.

I have read this e-form carefully before filling it, and I fully understand what it means and what I am agreeing to. I hereby acknowledge that test riding any vehicle is inherently dangerous and fully realize the dangers of test riding any electric bike, particularly when test riding for the first time.

What are the risks involved?

I fully assume the risk associated with such test ride, including, by way of example only, (i) the dangers of collision with pedestrians, vehicles riders of other vehicles, and fixed and moving objects; (ii) the dangers arising from surface hazards (including curbs, sudden changes in surface elevation, slick or wet surface, and potholes), equipment failure, inadequate safety equipment, negligence and weather conditions; and (iii) the possibility of serious physical and/or mental trauma, injury, or death associated with the activity of riding a bike.

What am I taking responsibility for?

I hereby agree that it is my sole responsibility to ride a bike so as not to endanger either myself or others. I hereby accept full responsibility for the condition and adequacy of the test ride vehicle and my conduct and agree to cease immediately riding the test ride vehicle if any problems should arise from its operation. I hereby agree to prove for myself and wear a helmet that can protect me against serious head injury, assuming all responsibility and liability for the selection of the helmet. I have no physical or mental condition which would endanger myself nor others or would interfere in any way with my ability to use a bike.

What is the information collected below used for?

I hereby agree with the consent to having my contact information added to VMG bikes mailing list. I hereby agree that I, and I alone, will be test riding the bike and I will not provide the bike to others for any use.

This e-form may not be modified orally, and a waiver or modification of any provision shall not be construed as a waiver or modification of any other provision herein or as a consent to any subsequent waiver or modification. Every term and provision of this e-form is intended to be severable. If any are found to be unenforceable or invalid, that shall not affect the terms and provisions, which shall remain binding and enforceable.
